Debt collectors and robocalls

Sued over a debt, or called until you dread the phone

Debt collectors have to follow rules: when they can call, what they can say, and what they have to prove before a court can order you to pay. Many debt buyers sue on old accounts with thin paperwork and count on people not answering.

Answering the lawsuit on time changes that. And when a collector or a company breaks the calling rules, the law can make it pay you, and pay your lawyer.

Call us if

  • You were served with a lawsuit over a credit card, medical bill or old loan

  • A collector calls your job, your family or late at night

  • You're getting autodialed or prerecorded calls you never agreed to

  • A collector threatened arrest, jail or wage garnishment without a court order

Questions about collectors

I was served. How long do I have?

Not long, often a few weeks, and the clock started the day you were served. Call us the same week.

What if I really do owe it?

You still have rights. Many collectors can't prove the amount or that they own the debt, and a settlement may cost far less than the claim.

Can they take my paycheck?

Not without a court judgment first. That's why answering the lawsuit matters.

How do I prove the robocalls?

Screenshots of your call log and any voicemails are a good start. Keep them, and don’t call the numbers back.

Got court papers or calls? Talk to Dario.

Send the paperwork you have, or call and talk it through.

Lemon, debt-collection and credit-reporting laws often make the company pay the consumer's lawyer fees when the consumer wins. We advance filing fees and other case costs; if we recover nothing, you owe us neither fees nor costs.
